Agreement to these terms
These Terms of Service (“Terms”) are a binding agreement between you and the operator of moonlight.photo (“Moonlight,” “we,” “us,” or “our”). They govern your access to our website, AI image and video studio, and related services (collectively, the “Service”).
By creating an account, purchasing credits or a subscription, or using the Service, you agree to these Terms and our Acceptable Use Policy. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old and legally able to enter into a contract. If you use the Service on behalf of a company or another organization, you represent that you have authority to bind it, and “you” includes that organization.
Your account
Moonlight currently uses Google as its sign-in provider. You must provide accurate account information, maintain control of the connected Google account, and promptly notify us of suspected unauthorized access. You are responsible for activity that occurs through your account unless caused by our breach of these Terms.
You may not share, sell, transfer, or create accounts in bulk, or use another person's account without permission. We may require reasonable verification before restoring access or acting on an account request.
The Service
Moonlight provides tools for generating and editing images and animating images into videos with prompts, source photos, and reusable references. Features, models, providers, output resolution, processing times, and credit costs may change as the Service evolves.
We may impose reasonable usage, file-size, storage, or rate limits to operate the Service safely and reliably. We do not guarantee that every request will complete or produce a particular result.
Your content
As between you and Moonlight, you retain the rights you have in photos, videos, prompts, reference names, and other materials you submit to the Service (“Your Content”). You represent that you have all rights, permissions, and consents needed to upload and use Your Content and to direct the requested transformation.
You give Moonlight a limited, worldwide, non-exclusive license to host, copy, transmit, modify, and process Your Content only as needed to provide, secure, maintain, and improve the Service, enforce our policies, and comply with law. This license ends when Your Content is deleted, except for copies retained in backups or as legally required.
You are responsible for Your Content and for the consequences of creating, publishing, or sharing it. Do not upload confidential or sensitive material unless you accept the processing described in our Privacy Policy.
AI output
Subject to applicable law, these Terms, and any third-party rights, Moonlight does not claim ownership of images or videos generated for you (“Output”). Laws concerning AI-generated material vary and may not recognize exclusive rights in every Output.
AI systems can produce inaccurate, unexpected, offensive, or similar results for different users. Output may resemble existing people, places, brands, or works by coincidence. You must review Output and determine whether your intended use is lawful, accurate, appropriate, and respectful of others' rights. Do not represent Output as authentic footage, a photograph, or an event when doing so would be deceptive or harmful.
Consent and real people
You may use a real person's likeness only when you have a lawful basis and all permissions required for the source material and the requested edit. Creating intimate, sexual, defamatory, deceptive, exploitative, or otherwise harmful content involving a real person without their explicit consent is prohibited. Public availability of a photo or public-figure status does not eliminate these obligations.
By creating an account or continuing to use Moonlight, you confirm that these representations apply to every photo you upload and every transformation you request. Moonlight relies on this account-level confirmation instead of asking you to repeat it for each upload or creation.
Acceptable use
You must comply with our Acceptable Use Policy, which is part of these Terms. Among other things, you may not use Moonlight for content involving minors in sexual or exploitative contexts, non-consensual intimate imagery, unlawful content, impersonation, fraud, harassment, or attempts to bypass safety systems.
We may use automated systems and, where necessary, human review to enforce these rules. We may block requests, remove content, limit features, suspend or terminate accounts, preserve evidence, and report conduct when we reasonably believe it is necessary to protect people, the Service, or comply with law.
Privacy
Our Privacy Policy explains how we collect, use, store, and share information, including Google account data, photos, prompts, and generation records. Please review it before using the Service.
Subscriptions, credits, and payments
Paid features may be offered through subscriptions or one-time credit add-ons available to active subscribers. Prices, included credits, billing frequency, renewal terms, and any expiration or rollover rules shown at checkout are part of these Terms. Unless checkout states otherwise, subscriptions renew automatically until canceled.
Credits are a limited, revocable license to use eligible Service features. They have no cash value, are non-transferable, and are not a bank account, stored-value account, or property right. We may correct balances affected by error, fraud, chargeback, or abuse.
You authorize our payment processor to charge the payment method you provide, including applicable taxes. You can cancel a subscription before its next renewal using the available account or billing controls. Except where required by law or expressly stated at purchase, charges and used credits are non-refundable.
Third-party services
The Service depends on third parties, including Google, Stripe, hosting, storage, and AI-infrastructure providers. Their services may be subject to separate terms and may become unavailable. Moonlight is not responsible for third-party services outside our control, but we may change providers or workflows to preserve quality, safety, reliability, or cost.
Moonlight property
The Service, including its software, design, branding, documentation, and non-user content, is owned by Moonlight or its licensors and is protected by intellectual-property laws. These Terms give you a personal, limited, non-exclusive, non-transferable, revocable right to use the Service. They do not permit you to copy, resell, reverse engineer, scrape, interfere with, or create derivative services from the Service except where law expressly allows it.
Changes, suspension, and termination
We may add, change, suspend, or discontinue features. When reasonably possible, we will provide notice of changes that materially reduce a paid Service. We may suspend or terminate access immediately if you violate these Terms, create risk or legal exposure, fail to pay, or threaten the Service or another person.
You may stop using the Service at any time and may request account deletion by emailing hello@moonlight.photo. Provisions that by their nature should survive termination will survive, including ownership, payment obligations, disclaimers, liability limits, indemnity, and dispute provisions.
Disclaimers
To the maximum extent permitted by law, the Service and Output are provided “as is” and “as available.” Moonlight disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the Service will be uninterrupted, secure, accurate, or error-free. Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable law.
Limitation of liability
To the maximum extent permitted by law, Moonlight and its affiliates, officers, employees, agents, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, or business opportunity arising from the Service, even if advised that such damages are possible.
To the maximum extent permitted by law, their total aggregate liability for claims relating to the Service will not exceed the greater of $100 USD or the amount you paid Moonlight for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited.
Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless Moonlight and its affiliates, officers, employees, and agents from claims, losses, liabilities, and reasonable expenses arising from Your Content, your use of Output, your violation of these Terms, or your violation of another person's rights. This obligation does not apply to the extent a claim results from Moonlight's own unlawful conduct.
Disputes
Before filing a formal claim, you and Moonlight agree to try to resolve the dispute informally for at least 30 days. Send a written description of the dispute and requested resolution to hello@moonlight.photo. These Terms do not prevent either party from seeking emergency or injunctive relief, and they do not limit rights that cannot be waived under applicable consumer law.
General terms
If a provision of these Terms is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, acquisition, or sale of assets. These Terms, the Acceptable Use Policy, the Privacy Policy, and checkout terms are the entire agreement between you and Moonlight concerning the Service.
Updates and contact
We may update these Terms from time to time. We will post the revised Terms here, update the effective date, and provide additional notice when required. Continued use after revised Terms take effect means you accept them; if you do not, you must stop using the Service.
